LEP (limited English proficiency)

Limited English proficiency (LEP) is a functional description used in federal language-access guidance. A person may communicate effectively in some situations and still need language assistance for a different service or subject.

Consider the service and conversation

HHS describes an individual with LEP as someone whose primary language for communication is not English and who has limited ability to read, write, speak, or understand English. A person’s English ability can vary by task; understanding everyday conversation does not necessarily mean they understand specialized healthcare, legal, or technical language.

Ask participants what language and communication support they prefer. Do not infer preference or ability from citizenship, birthplace, name, or appearance. For covered programs, consult current legal requirements and organizational policy to determine the language assistance needed.

Use population data carefully

Census and other demographic estimates can support service planning, but they do not determine an individual’s language preference or whether a person needs an interpreter. Confirm the person’s needs directly and apply the rules relevant to the service.
